<content:encoded><![CDATA[<blockquote><blockquote><p>目前打算係試用期內(約兩個半月時)辭職，但期間有2日紅日假期，另外請左2日有薪病假以及1.5日年假。<br />
合約內文只寫明The Employee work shifts based on the roster per week (forty-eight (48) hours per week). If an employee fails to report for duty on time, employee is considered late. Under a continuous contract, the Employee is entitled rest days and statutory holidays. Corresponding leave pay will be deducted in the final payment for resignation within three (3) months.<br />
每天工作9小時(連1小時用飯時間)，星期六上班半日，星期日休息天。但當初簽合約時有另外有一份協議簽明是五天工作，所以平日都會有半日的half day off。但請病假後被通知，請病假一天需要取消一次half day off,所以兩日病假合共取消兩次half day off。</p>
<p>想知道如果辭職，薪金會點計算？ </p>

<blockquote><blockquote><p>另外我知道根據勞工法例試用期內離職公司可以扣除相關的紅日,病假,年假的薪金。但好似病假甘，已經被扣除左相應既half day off，甘請公司仲可唔可以係最後薪金結算既時候因有請過病假而扣減相應薪金？</p>
</blockquote></blockquote><p>根據僱傭條例,按連續性合約受僱,病假不少於連續4天可享有疾病津貼。除非合約有寫明1天病假或以上都會以全薪計算,否則2天病假可以不獲疾病津貼。若果以DAY OFF去扣除則是不合僱傭條例,因為僱主不能扣減員工休息日。</p>

目前已收到一個半月薪金，準備於一個月後離職。另外本人是月薪制的，合約內沒有列明休息日是否為無薪。</p>
