但我睇番自己CONTRACT的內容, 當中有列明如果病假係一日/少於一日, 係可以唔使提供醫生紙<br />
但後來老闆堅持話合約咁寫, 意思係指: </p>
<p>如果我無提供醫生紙 -- 就當扣錢/扣假<br />
如果我提供醫生紙--- 先係有薪病假</p>
<p>希望有人可以解答到我, 如果根據以下的合約內容, 我係咪有權爭取番請病假個日為有薪病假? </p>

Sickness Allowance </p>
<p>The Employee is entitled to sickness allowance equal to normal salary under the following circumstances </p>
<p>- <span style="color:#f00;">the number of sickness days taken is not more than one consecutive day and a total of not more than of one days in one calendar month (applicable to sick leaves without medical certificates)</span>;</p>
<p>- the cumulative number of sickness days (with valid medical certificates) is not more than twelve (12) days in a calendar year from the commencement of the particular sickness days; </p>
<p>- if the sickness day is less than or equal to one day, the Employee can submit or not submit a valid medical certificate, if the number of sickness days is more than one consecutive day, the sick leave must be supported by a valid medical certificate, and </p>
<p>-unless expressly provided above, the remaining arrangement will be stipulated according to Employment Ordinance.</p>
</blockquote><p>多謝閣下的查詢，閣下的問題主要在病假的確認上，合約例明病假一天是有薪，但是沒有醫生紙如何證明是病假呢，因此閣下的情況有幾項需要注意，1)請病假時是否通知僱主及了解當日的處理，2)公司之前有否相同的慣例，如合乎這兩點，公司又承諾了當日是有薪的話，公司就不能在之後反口了，相反的話如出現糾紛，閣下是很難證明的。如有其他查詢，可致電：27793766高先生/蔡先生</p>
