<p>想問已通知公司懷孕中，公司可以用員工 Repudiatory breach employment contact導致行為不當來解雇懷孕中的員工？</p>
</blockquote><p>1.依勞工法例<br />
僱主只可在以下情況下解僱懷孕僱員：<br />
• 如僱員犯嚴重過失而被即時解僱；或<br />
• 如僱傭合約有明確協定有試用期，僱主可在不多於12星期的試用期內解僱僱員，惟僱主不得由於僱員懷孕而將其解僱。</p>
<p>2.犯嚴重過失而被即時解僱會導致員工喪失勞工法定權益，舉證門檻相當高，唔係亂講亂作就過到關。</p>
<p>3.哥頭向公司提供懷孕通知，呢頭Repudiatory breach？時間太巧合，令人有合理懷疑無良僱主推砌理由剝削勞工法定權益。</p>
