關於第十三個月糧
小弟於2023年11月入職新公司,當中關於第十三個月薪酬的條款注明如下:
The Employee shall be entitled to an End of Year Payment of one month's salary upon completion of each calendar year. If the employment is terminated for any reason before the end of the year, the employee will not be entitled to the End of Year payment;
現公司表明因小弟在年底前未過試用期而拒絕發放第十三個月薪酬,請問是否有違反契約之嫌?
