已接受新工作的offer, 但是尚未上班和簽contract。 Offer 上寫着以下內容:

Indemnity Clause for Accepting Appointment

By signing and returning this offer letter, you agree that if should you fail to commence your employment hereunder on the commencement date thereby acting willfully in default of your commitment to commence employment with our Company, you shall be deinemed to have wrongfully repudiated your agreement with our Company’s practice and shall pay our Company liquidated damages in the sum equivalent to one month’s base salary being the agreed amount of loss and damages incurred by our Company in the management time, effort and expenses incurred by our Company to source and offer your employment.

如果我選擇不上班和拒絕上班的話會被追討索償嗎,謝謝。


未做過毀約的賠償條款
btw僱傭合約有明文規定,在試用期內的首個月,可以無需通知期或代通知金,即時離職。

首先, 建議你拎住份contract 直接去勞工辦事處問當值ge勞工處職員。
