多謝閣下的查詢，年假及有薪病假是僱傭條例規定的勞工保障，合約是不能違反法例的，因此閣下合乎法例規定，就可以享有年假及有薪病假了。根據僱傭條例，病假連續4天或以上、有註冊西醫、註冊中醫或註冊牙醫簽發的證明書及已經累積了有薪病假，便可享有疾病津貼，而有薪病假在入職首一個月開始累積，首12個月每月累積兩天，第二年開始每累積四天，上限為120天。而年假是按年遞增的，首兩年每7天年假，由第3年開始每年遞增一天，遞增至14天，而僱員工作滿三個月後，除非因為嚴重過失被即時解僱，否則無論自己辭職或是被解僱都可以享按比例年假。如有其他查詢，可致電：27793766
