本人於2021年12月15號向公司離職，
離職日期是2022年1月15號，
但公司聲稱不會發放雙糧給我，
原因是因自行離職及未到新年不能發放雙糧。
以下是有關合約內容：
2.Salary
Your Monthly salary will be increased after the probation from $16000 to $17000 and your total annual compensation will be $221000 (HKD$17000 per month with a 13th month pay) and will be subject to annual performance review.

如以上合約內容，公司是否應該要出雙糧

除非合約另有規定,否則僱員在酬金期完結前辭職,不可享有按比例計算的年終酬金。所以你自己離職公司原因是因自行離職及未到新年不能發放雙糧。是不違法的。
