員工失誤導致公司有損失, 可要求賠償最高金額是多少?
就跟據<<僱傭條例>>第三章:工資
扣薪
2. 僱員因疏忽或失職而損壞或遺失僱主的貨品、設備或財產,每次只可按值扣除,但以不
超過$ 300 爲限。此外,在這些情況下扣除的工資總額,亦不得超過僱員該工資期所得工
資的四分之一;
2. deductions for damage to or loss of the employer's goods,
equipment, or property by the employee's neglect or default. In any
one case, the sum to be deducted shall be equivalent to the value of
the damage or loss but not exceeding $300. The total of such
deductions shall not exceed one quarter of the wages payable to
the employee in that wage period;
公司的政策如下:
There is a new company policy: If due to our mistakes or careless, we (company) have to pay any penalty, compensation for or to our clients, which includes paying government penalty, fee for replacement of visa label/passport, etc.
1) 針對以上是否符合扣薪資格
2) 針對以上公司政策, 如僱員失誤令公司客人有罰款(eg,政府罰款)/遺失客人私人物件, 僱主(公司)是否可以要求僱員賠償, 是否可以扣薪而金額是否以不超過$ 300 爲限? (但據英文版 penalty not relate to employer's goods, equipment, or property)
3) 如在 Dec 20 就因僱員失誤令客人有政府罰款 $3000, 公司出一半 $1500, 另一半從僱員人工中扣除, 如不符合扣薪資格或只可以扣 $300, 僱員還可以有申索期為多出的薪金索償嗎?
4) 如不符合扣薪資格, 但公司扣薪是退還給客人(實報實銷), 是否也屬違法, 不涉及金額入公司戶口
4) 如僱員就以上 (在 Dec 20 就因僱員失誤令客人有政府罰款 $3000)向僱主索償被僱主拒絕是否違法
