Termination?
'Notice of Termination: Your employment with the company may be terminated by either party giving 1 months' notice to the other party, without assigning any reasons whatsoever'
My contract lasts from 1st May,2014-1st May, 2015, however, I am asked to change from full-time to part-time with a big reduction in salary on 26th January, 2015. Does this mean I will be stop working for my boss on 26th February, 2015, and he will have to pay me the full-time salary for that month as well?
Also, for my MPF, it was stated in the contract as 'Your monthly salary is HK$22000 including all insurance and MPF contributions. xx Limited will pay insurance and MPF contributions on your behalf.' However, every month, I only receive $19800 in my bank account, is that legal and correct?
多謝閣下的查詢,以閣下的情況,合約是由2014年5月1日至2015年5月1日,但閣下在1月26日轉為兼職,即1月份1月25號的薪金應照全職計算,而26至31即按兼職。不過有一個問題,轉兼職的安排是閣下要求,還是僱主要求呢?如閣下要求,即按上述做法便可以,但如果是僱主要求,閣下便需要考慮是否願意合約的更改,如果閣下不同意,僱主不能強行更改合約,如果僱主強制執行,即可能屬於不合理更改僱傭合約,閣下是可以引用僱傭條例,當僱主變相解僱,申索僱主終止僱傭金及其他解僱補償,例如一個月代通知金、按比例年假等...
另外強積金方面,法例只規定僱員以入息的5%的金額作供款,如果僱主多扣了薪金,是違反了僱傭條例的,不過依閣下所說,公司在扣薪的部分,除強積金外,是作保險之用,則需要閣下同意才可以進行,如果閣下不同意,公司是不能扣除閣下的薪金來作保險費用的。
