我 2015.8.11開始上班,一個月有6日假,我打算2015.8.30是最後一日上班。
那麼我應何時交resignation letter?? 會在多少人工? PROBATION 前是否1日通知? 但合約寫一個月通知?我應?


1) Remuneration: The Employer will pay you a gross monthly salary of HKD 11,000 HKD during 3 months probation period. Validity of salary is one year.

2) Termination for Cause: The Employer may terminate this employment agreement and employment at any time for cause without notice and without payment of any compensation, either by way of anticipated earnings or damages of any kind.

3) Termination on Notice: You or the Employer may terminate this agreement and employment at any time upon giving one month written notice to the other party. Notwithstanding the foregoing, the Employer may terminate this agreement immediately upon paying to you one month salary in lieu of such notice.

多謝閣下的查詢,根據僱傭條例,僱傭雙方於試用期第一個月內均可即時終止僱傭合約,無須給予通知期或代通知金。

2星期後7 日通知

咁仲會不會跟勞工法?

法例中僱傭合約是指僱主和僱員訂立的僱傭協議。僱傭合約可以書面或口頭方式訂立,並可包含明言或暗示的條款。 只要不違反《僱傭條例》的規定,勞資雙方可自行訂立合適的僱傭條款及條件,但任何僱傭合約的條款,如有終止或減少《僱傭條例》所賦予僱員的權利、利益或保障的含意,即屬無效。故入職時要了解合約條件是否低於法例標準以下。

真係合約就算寫明一個月但試用期內就可以無視?

如雙方合約在合約遵循上就法例的標準引起爭議,可往勞工處就引起之疑問由法庭作出仲裁。
