有關有薪年假及有薪病
The employment of the Representative will be subject to a Three Months Probation within which: (a) during 1st Month of the Probation, either party may terminate this contract by giving the other party one-day written notice or payment in lieu of notice; and (b) during the 2nd month to 3rd month of the Probation, either party may terminate this contract by giving the other party seven-day written notice or payment in lieu of notice. During the probation period, the Representative is not entitled to any paid annual leave and paid sick leave.
那代表過了試用期可以享有有薪年假及有薪病嗎?但沒有定明多少天可以享有病假多少天那我可享有多少天病假呢!
另外那沒有定明有薪年假沒有定明上限,那我可以三年後加年假期呢!有年假14天的。
多謝閣下的查詢,年假及有薪病假是僱傭條例規定的勞工保障,合約是不能違反法例的,因此閣下合乎法例規定,就可以享有年假及有薪病假了。根據僱傭條例,病假連續4天或以上、有註冊西醫、註冊中醫或註冊牙醫簽發的證明書及已經累積了有薪病假,便可享有疾病津貼,而有薪病假在入職首一個月開始累積,首12個月每月累積兩天,第二年開始每累積四天,上限為120天。而年假是按年遞增的,首兩年每7天年假,由第3年開始每年遞增一天,遞增至14天,而僱員工作滿三個月後,除非因為嚴重過失被即時解僱,否則無論自己辭職或是被解僱都可以享按比例年假。如有其他查詢,可致電:27793766
