你好，請問僱傭合約中有以下一段
“20.third parties right:you agree to opt out the the Contract (Rights of the Third Parties) Ordinance (Hong Kong Law) which includes express exclusion, ie. any person or entity who is non-party to the Employment Contract shall have no rights to enforce any terms and conditions as stated in it."
針對呢段文字，有幾個問題：
1.）呢段文字對僱員有什麼影響？（例如不可向僱主索償？又或者意思是僱主可以不按勞工法例？）

2.）假設合約中有與勞工法例所牴觸的條款，而雙方又簽了，那是否合約就可以凌駕法例？
