非常感謝你地的回覆，公司的說法是根據我的合約條文，如下:

"In the event of resignation, unless otherwise agreed, annual leave entitlement will be calculated up to the last day worked and be based on statutory entitlement not the Company additional leave"

即係公司只會比返無攞既法定有薪年假，而優於法定有薪年假的有薪假，未攞的話，公司不會補返錢。　雖然以上條文冇講明未攞優於法定有薪年假的處理部分，之前辭咗職的同事有反映番公司會如上處理。

請問以上合約條文有否違法？

雖然合約寫咗，公司食咗我既年假是否有不妥？
出來做野１０幾年第１次遇到咁既情況，３年前唔係急於轉工都唔會中計。
