試用期內離職,公眾假期不包薪

你好,我有以下問題請教:

本人4月3日開始上班,5月31離職,
1)就以下資訊,請問 公司是否可以扣除 公眾假期的薪金?

公司根據勞工法,未過試用期,要求扣除5月1日 及5月22日 公眾假期薪金,

*我當時翻看 公司的員工手冊,關於假期,文字只有一句 (沒有註明 試用期員工是否適用) : all employee will be entitled public holidays published in the government gazette.

*另外,手冊有一段關於 employee的解釋,文字是: Unless you are employed as a temporary employee or on specific terms, you are a member of our permanent staff The period of employment shall, unless otherwise specified, be initially on probation for three months of such other period as agreed and thereafter unless earlier determined shall continue until the employee's normal retirement date.
An employee does not become a permanent employee until he has successfully completed his period of probation which may be extended beyond the initial period of probation and has been advised in writing accordingly.


2)同時,公司通知我 會將4月5日清明節 (上個月已經發給我的薪金) 扣回,請問這樣可以嗎?
